1. Introduction
These Terms apply to all bookings made with Esta Travels ("we", "us", "our") whether through our website, WhatsApp, phone, email, or offline through our representatives. If you do not agree with any part of these Terms, you should not proceed with a booking.
You confirm that you are at least 18 years old and legally competent to enter into a binding agreement and to accept these Terms on behalf of yourself and all travellers included in your booking.
2. Company Details and Service Area
Esta Travels operates as a partnership business based in the State of Sikkim, India. Our primary focus is designing and arranging tour packages, local transport and related ground services.
Geographical service area: Our tour packages and travel services are offered only within:
- The entire state of Sikkim
- Siliguri (West Bengal)
- Darjeeling (West Bengal)
- Kalimpong (West Bengal)
We do not provide tour plans, packages or travel services for any other regions of India or for any foreign countries beyond the areas listed above.
Our Services are available to both Indian and foreign travellers, subject to applicable local laws, permit requirements and documentation rules.
3. Role as Agent and Third‑Party Services
For many components of your trip, Esta Travels acts in the capacity of a booking agent for independent service providers, including but not limited to hotels, homestays, transporters, local guides and other contractors.
All vouchers, receipts, confirmations and tickets issued by us are subject to the terms and conditions of the third‑party service providers responsible for delivering those services.
We are not responsible for the acts, errors, omissions, representations, warranties, negligence or misconduct of any such third parties or for any personal injury, death, property damage, or other damages or expenses resulting therefrom.
4. Services Provided
Within our service area, we may provide or arrange:
- Fixed tour packages and curated itineraries
- Custom tour planning based on your requests
- Local transportation and sightseeing by car or similar vehicles
- Hotel, homestay and similar accommodation bookings
- Local permits and basic ground handling, where applicable
We do not book or sell flights or train tickets. If you independently book flights or trains, you are responsible for coordinating timings with the ground arrangements.
Services can be booked via our website (including custom tour request forms), WhatsApp, email, phone or in‑person communication with our representatives.
5. Booking, Confirmation and Contract
A booking request is considered provisional until we confirm availability and receive the required advance payment. Your contract with Esta Travels is formed only when:
- We confirm your itinerary and price in writing (email, WhatsApp or similar), and
- We receive the agreed advance payment within the specified time.
All sample itineraries shown on our website or shared with you are indicative and may change based on actual conditions. The final confirmed itinerary will be as mentioned in your written confirmation.
6. Pricing, Inclusions and Exclusions
Our rates are based on prevailing prices negotiated with hotels, transporters and other suppliers at the time of quotation. These rates may vary without prior notice if the underlying supplier rates or taxes change.
After the tour or service cost has been finalised, any increase in government taxes, entrance fees (for monuments, museums, parks, etc.), fuel costs, permit charges or guide fees imposed by authorities may be charged to you as an extra cost.
Unless otherwise specified, package prices generally include only those items expressly mentioned as inclusions in your confirmed itinerary. All other items are considered exclusions and must be paid for separately.
Hotel bookings are usually based on standard check‑in and check‑out times of the respective hotels, unless a different time is clearly indicated in your itinerary.
7. Payments and Advance
For all Services contracted, an advance payment is required to hold bookings on a confirmed basis. The amount of advance and the due date are decided by our management based on the nature of the Service, season and time left before commencement.
The balance amount must be paid either before your departure from your home location or upon arrival in India, but always before the commencement of the Services. If the balance is not received on time, we reserve the right to cancel the booking and apply the cancellation charges described below.
Payment instructions, acceptable modes of payment and due dates will be communicated to you at the time of booking confirmation.
8. Cancellations, No‑Shows and Refunds
If you wish to cancel your booking, you must send a written cancellation request by email or message on working days (Monday to Saturday). Any cancellation sent on a Sunday or public holiday will be treated as received on the next working day.
Unless specified otherwise in your individual booking, the following cancellation charges generally apply on the total tour / service cost:
- 30 days or more prior to arrival: 10% of the tour / service cost
- 15–29 days prior to arrival: 30% of the tour / service cost
- 7–14 days prior to arrival: 50% of the tour / service cost
- Less than 48 hours prior to arrival or No‑Show: No refund
Certain services, such as special permits, peak‑season bookings or non‑refundable hotel reservations, may be subject to stricter cancellation terms. In those cases, the specific terms communicated for those services will prevail.
Approved refunds will usually be processed through the same payment channel used for the original transaction and may take approximately 10–15 working days, subject to bank and payment‑processor timelines. Non‑recoverable supplier charges, bank fees and payment gateway charges may be deducted from the refund.
9. Changes and Itinerary Modifications
Itineraries are sample plans intended to give a general idea of the likely trip schedule. Factors such as weather conditions, road conditions, traffic, local events, government restrictions and the physical ability of participants may require changes before or during the trip.
We reserve the right to modify or rearrange the itinerary, change hotels, vehicles or routes, or omit or substitute sightseeing points in the interest of safety, comfort and general well‑being of the participants.
Any additional expenses arising from such changes, where not caused by our negligence, shall be borne by you.
10. Force Majeure and Limitations of Liability
We shall not be responsible for any delays, changes, or cancellations of your programme or additional expenses incurred, directly or indirectly, due to events beyond our reasonable control, including but not limited to:
- Natural hazards and acts of God (landslides, floods, earthquakes, storms, etc.)
- Adverse weather or road conditions
- Flight, transport or equipment breakdowns and cancellations
- Epidemics, pandemics, medical emergencies or quarantine restrictions
- Strikes, bandhs, political disturbances, civil unrest or government orders
- Changes in customs, immigration or permit regulations
- Any other unforeseen circumstance beyond our control
We shall not be liable for any loss, injury, accident, damage or expense to person or property in connection with any accommodation, transport or other services resulting directly or indirectly from the above causes or from the acts or omissions of any third party.
Subject to applicable law, our total liability, if established by a competent court and not otherwise excluded, shall not exceed the amount actually paid to us for the portion of the Services directly affected.
11. Travel Insurance
We do not provide any travel, medical, baggage or cancellation insurance. You are strongly advised to arrange suitable insurance in your home country that covers at least:
- Medical expenses and emergency evacuation
- Personal accident and death
- Loss, theft or damage of baggage and personal belongings
- Trip cancellation or curtailment, where available
All baggage and personal property remain at your own risk at all times.
12. Traveller Responsibilities and Health
By booking with Esta Travels, you confirm that you and all members of your party are physically and mentally fit to undertake the chosen itinerary, including travel to hilly or high‑altitude areas where applicable.
You agree to carry valid identity documents and permits as required, follow instructions of guides, drivers and local authorities, respect local customs and the environment, and avoid any unlawful or disruptive behaviour.
We reserve the right to refuse service or remove any traveller from a tour, without refund, if their behaviour is unsafe, abusive, illegal or seriously disruptive to the group or local community.
13. High‑Altitude and Adventure Activities
Some itineraries may involve travel to high‑altitude areas or participation in soft‑adventure activities. Such activities carry inherent risks including, but not limited to, altitude sickness, harsh weather, limited medical facilities and challenging terrain.
By choosing such activities, you acknowledge and accept these risks and participate voluntarily and at your own responsibility.
14. Use of Website and Communications
Our website content, including text, images, logos and itineraries, is owned or licensed by Esta Travels and is protected by applicable intellectual property laws. You may use the website only for personal, non‑commercial purposes related to planning or booking travel with us.
We may contact you via email, WhatsApp, phone or SMS regarding enquiries, bookings, confirmations and service‑related updates.
15. Personal Data and Privacy
To process bookings and provide Services, we may collect limited personal data such as names, contact details, identification details and travel preferences. We use this information only for:
- Arranging travel services and permits
- Communicating about your bookings
- Fulfilling legal or regulatory obligations
We take reasonable steps to protect your data but cannot guarantee absolute security against all threats. By providing your information, you consent to its use for the above purposes. A more detailed privacy policy may be provided separately on our website.
16. Complaints and Support
If you experience any issue during your trip, you should inform us or our local representative as soon as reasonably possible so that we have an opportunity to resolve it while you are still travelling.
Complaints raised only after the trip has ended, without giving us a chance to rectify the issue during the journey, may be more difficult to verify and resolve.
17. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with your booking shall be governed by and construed in accordance with the laws of India.
Subject to any mandatory consumer‑protection provisions, you agree that the courts having jurisdiction in the State of Sikkim, India, shall have exclusive jurisdiction over all disputes relating to these Terms or your use of our Services.
18. Amendments and Acceptance
We may amend these Terms from time to time. The version in force at the time of your booking, or as specifically agreed in writing, will apply to your contract. Updated Terms will generally be posted on our website with a revised effective date.
By making a booking with Esta Travels through any channel, you confirm that you have read, understood and agreed to these Terms and Conditions on behalf of yourself and all members of your travelling party.
